Prevailing Defense LLC

By registering for or attending any class, course, or training event offered by Prevailing Defense LLC (“we,” “us,” or “the Company”), you agree to the following terms.
1. Eligibility
You must be at least 18 years of age (or the legal age required by the host range and Washington state law) and legally able to possess and handle firearms under all applicable federal, state, and local laws. You are solely responsible for confirming your legal eligibility before registering.
2. Assumption of Risk
Firearms training involves inherent risks, including but not limited to serious injury, permanent disability, or death. By participating, you voluntarily assume all risks associated with firearms handling, live-fire exercises, movement, and training environments. You acknowledge that no amount of instruction can eliminate these risks.
3. Safety Rules & Compliance
You agree to follow all safety rules given by instructors and the host range at all times. Failure to follow safety instructions may result in immediate removal from the class without refund. We reserve the right to refuse service or remove any student whose behavior creates an unsafe condition.
4. No Guarantee of Results
Instruction is provided for educational and skill-development purposes only. We make no guarantees regarding your performance, retention of skills, or ability to use firearms in any real-world situation.
5. Medical & Physical Condition
You represent that you are physically and mentally capable of safely participating in the training. You agree to inform the instructor of any condition that may affect your ability to safely handle firearms or participate in physical activity.
6. Equipment
You are responsible for the safe condition and legal status of any firearm or equipment you bring. We are not responsible for damage to or loss of personal property.
The following items are not permitted in any class:
SERPA holsters (or any holster that uses a similar trigger-finger release mechanism)
SIG Sauer P320 pistols in any configuration (including X-Series, Legion, or any variant)
Students bringing prohibited equipment will not be allowed to participate until the item is removed. No refund will be issued in these cases.7. Payment, Cancellation & Refunds
Payment is required to reserve your spot.
Cancellation policy: Full refund if cancelled 7+ days before class, 50% within 7 days, no refund for no-shows or same-day cancellations. We reserve the right to cancel or reschedule classes due to weather, instructor availability, range issues, or low enrollment. In those cases you will receive a full refund or the option to transfer to another date.
8. Liability Waiver
To the fullest extent permitted by law, you release, waive, and discharge Prevailing Defense LLC, its instructors, owners, agents, and the host range from any and all claims, liabilities, or damages arising out of your participation in training, including claims based on negligence (except gross negligence or willful misconduct).
9. Media
We may take photos or video during classes for instructional, promotional, or documentation purposes. By attending, you consent to this use unless you notify us in writing before the class that you do not consent.
10. Governing Law
These terms are governed by the laws of the State of Washington. Any disputes will be resolved in the courts of King County, Washington.
11. Changes
We may update these terms from time to time. The version in effect on the date of your registration applies to that class.
12. Privacy Policy
We collect only the minimum information necessary to run our classes. This is limited to:
Your name
Your email address
We use this information solely to communicate with you about class registration, schedule changes, reminders, and related training matters.
We do not sell, rent, or share your personal information with third parties for marketing purposes. We may share information only when required by law or when necessary to operate a class (for example, providing a student roster to the host range).
We retain your information only as long as needed for legitimate business or legal purposes. You may request that we delete your information by emailing us, subject to any legal retention requirements.
By registering for a class, you consent to this limited collection and use of your information.
